§1 Validity of GTC
By submitting an order, the customer expressly agrees to these GTC.

All orders are binding. Delivery times are not binding. You will be informed by e-mail if delivery is delayed. If the delivery has not yet been sent, you have the option of canceling it.

§2 Orders
When placing an order online, Atelier Agave AG requires information about the user (name, address, e-mail address, etc.). This information is used for the creation and processing of the business relationship between the customer and Atelier Agave AG. If a problem arises with the processing of an order, this information is used to contact the customer.

§3 Formation of the contract
The presentation of the product range of Atelier Agave AG does not constitute an offer to conclude a purchase contract with the customer. It is non-binding. By sending an order via the Internet (by clicking on the "Send order" button), the customer submits a binding offer to conclude a purchase contract. The customer receives confirmation of receipt of the order by e-mail (order confirmation). This order receipt confirmation does not constitute acceptance of the offer, but is only intended to inform the customer that the order has been received by Atelier Agave AG. A purchase contract is concluded when Atelier Agave AG accepts the customer's offer by sending the ordered product to the customer. If Atelier Agave AG cannot accept the customer's offer, the customer will be informed of the unavailability or rejection of the order instead of accepting the order.

§4 Returns
Returns are excluded if they are not accepted.

§5 Complaints
Can be made in writing to joel@atelieragave.com within 14 days of receipt of the goods. Atelier Agave AG shall, at its own discretion, deliver a replacement or cancel the purchase and refund the purchase price to the customer. Atelier Agave AG will reimburse the postage for the return shipment if defective goods are delivered.

§6 Data protection
The data required for business transactions will be stored and, if necessary, forwarded to the companies responsible for shipping and invoicing as part of order processing. All personal data will be treated confidentially and in accordance with the data protection regulations of Switzerland.

§7 Import of goods abroad
When importing goods into countries outside Switzerland, export restrictions may apply and import duties and taxes may be incurred which the customer must pay. These vary in different customs territories. The customer is responsible for the proper payment of the necessary customs duties, taxes and fees.

§8 Applicable law
The legal relationships are subject to Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISGG).

§9 Final provisions
Atelier Agave AG reserves the right to amend these General Terms and Conditions at any time. The currently binding version of the GTC can be viewed in the online store.
